How do you bill for your legal services?

For criminal matters, we require a flat fee to be paid in full prior to an attorney providing legal services. Our law firm believes that requiring a flat fee up front will eliminate any financial dispute or concerns while we represent you. This will ensure that you will have a lawyer that is focused on providing excellent  legal services, and not focused on collecting outstanding payments.

Yes, unless told otherwise by your attorney and/or the court. If you fail to show up to court for your criminal matter, the Judge may issue a bench warrant, which can result in you being arrested and detained while your case is pending.

What is an indictable offense?

An indictable offense in New Jersey is what most people outside of New Jersey call a felony. In New Jersey, there are four different types of indictable offenses: 4th Degree, 3rd Degree, 2nd Degree, and 1st Degree. Each degree has different types of penalties, with the least severe being 4th degree indictable offenses and the most severe being 1st degree indictable offenses.

What are the maximum penalties for indictable offenses?

If convicted for a 4th Degree indictable offense, you can be sentenced to up to 18 months in New Jersey State Prison, $10,000 fines, or both.

If convicted for a 3rd Degree indictable offense, you can be sentenced to 3-5 years in New Jersey State Prison, $15,000 fines, or both.

If convicted for a 2nd Degree indictable offense, you can be sentenced to 5-10 years in New Jersey State Prison, $150,000 fines, or both.

If convicted for a 1st Degree indictable offense, you can be sentenced to 10-20 years in New Jersey State Prison, $200,000 fines, or both.

If I write a letter to the Judge telling them what really happened, will it help my case?

No. Unless you request a bench trial, Judges in Superior Court do not determine whether you are guilty or not: that is the job of the jury. If you write a letter to the Judge about what really happened, the Prosecutor will get a copy of that letter and can potentially use it against you at trial.

What should I do if I am stopped by the police?

  1. If you are stopped by the police, the first thing you should do is breathe and calmly ask why the officer(s) stopped you. 
  2. Second, ask if you are free to leave? If you are free to leave, leave? 
  3. If you are not free to leave, request to speak to an attorney.
  4. DO NOT SPEAK TO ANY LAW ENFORCEMENT OFFICER UNTIL YOU HAVE SPOKEN TO AN ATTORNEY
  5. Under no circumstances should you attempt to resist or flee. If you do so, you will be charged with additional offenses that can be difficult to fight at trial.

It depends on several factors. The two most important factors are the type of charge(s) you are facing and the type of outcome you are looking to get. Other factors may include whether you have co-defendants, whether you may face possible immigration consequences, and whether you are detained or not.
